ELIGIBILITY: The Gaspari Nutrition Trip to the 2010 Olympia Weekend Sweepstakes (the "Sweepstakes") is open only to legal residents of the United States and the District of Columbia, 18 years of age and older at the time of entry and members of the U.S. military who reside at APO/FPO addresses outside of the U.S. Void in Puerto Rico, and where prohibited by law. Employees, directors and officers, and their immediate families (spouse, parents, children, siblings, and their respective spouses), including their respective household members, of Gaspari Nutrition, Inc., (Sponsor), and its respective parent companies, subsidiaries, affiliated and related entities and Strobe Promotions, Inc., and each of their respective officers, directors, employees, contractors, agents, successors and assigns, and prize partners are not eligible to enter. Sweepstakes is subject to all federal, state, and local laws. U.S. law governs this Sweepstakes.
3. SWEEPSTAKES TIMING/DESCRIPTION:The Sweepstakes begins at 12:00:00 AM ET on 9/4/09 and ends 11:59:59 PM ET on 8/31/10 (the "Promotion Period"). There will be a random drawing at the end of the Promotion Period to award one (1) Grand Prize, five (5) First Prizes and ten (10) Second Prizes. There will be monthly random drawings conducted throughout the Promotion Period.
4. HOW TO ENTER:To enter the sweepstakes, go online to www.revolution.gasparinutrition.com click on the “Experience the Revolution” text box, and complete and submit the online registration form. Limit one entry per day. All entries must be received by 11:59:59 PM ET on 8/31/10 in order to be eligible for the Sweepstakes. Monthly Random Drawings: Each time you enter the Sweepstakes during the Promotion Period, you will receive one entry into the Monthly Drawing for the month that you submitted your entry. A “month” for these purposes is defined as beginning 12:00:00 AM ET on the first day of the month (except for the Thursday of September, when it begins 9/3/09) and ending 11:59:59 PM ET on the last day of that month. All entries must be received at 11:59:59 PM ET on the last day of the month in order to be eligible for that monthly drawing. Limit one entry per person/email address per day. Monthly entries are not cumulative and are not eligible for subsequent monthly drawings during the Promotion Period. All entries must be received by 11:59:59 PM ET on 8/31/10. Normal time rates, if any, charged by Internet Service Provider will apply. Entries that have been generated by a script, macro, and bot or any other automated means will be deemed void. Duplicate entries submitted by the same person or the same email address on the same day voids all entries. Proof of emailing does not constitute proof of delivery. If a dispute results as to the identity of an entrant, it will be determined that the entry was submitted by the authorized account holder of the email address from which the entry is made. For these purposes, the authorized account holder is the natural person assigned to an e-mail address by an Internet access provider, on-line service provider or other organization responsible for assigning email addresses or the domain associated with the submitted email address.
5. DETERMINATION OF WINNERS:Grand, First and Second Prize winners will be selected in a random drawing held on or about September 3, 2010 from among all eligible entries received during the Promotion Period. Random drawing will be conducted by promotion administrator whose decisions are final on matters relating to this Sweepstakes. Potential Grand Prize winner will be notified and confirmed by electronic mail and/or U.S. or overnight mail on or before September 7, 2010. Potential Grand Prize winner will be required to complete and execute an affidavit of eligibility and liability release and where legal a publicity release and federal and state tax release and return same properly executed within seven (7) days of notification attempt. Non-compliance within this time frame for any reason whatsoever or if prize notification is returned as undeliverable will result in the entrant being disqualified and an alternate potential winner will be selected. Odds of winning a Grand, First or Second Prize depend upon the number of eligible entries received during the Promotion Period. Monthly Prize Winners: Ten (10) Monthly Prize winners will be selected in random drawings each month within three (3) days of the last day of the month (unless the last day of the month falls on a weekend; it will then occur the following Monday) from among all eligible entries received for that month as defined in Rule #4. Monthly winners will be notified by electronic mail and/or U.S. mail within three (3) days of their respective random drawings. Monthly winners may be required to verify their mailing address prior to issuance of prize. Odds of winning a monthly prize depend upon the number of eligible entries received for that month. Allow 4-6 weeks for awarding of prize. Limit one prize per monthly drawing per person or email address.
6. PRIZE DESCRIPTION: One (1) Grand Prize:A 4 day/3 night VIP trip for two (2) to the 2010 Olympia Weekend in Las Vegas, Nevada to train with Rich Gaspari including 3 nights’ hotel accommodations, double occupancy, round-trip coach class air transportation from major gateway airport nearest winner’s home to Las Vegas, VIP ticket package to the Olympia Weekend, (1) one-hour training session with Rich Gaspari for winner, (1) Autograph session with Team Gaspari athletes, a Revolution prize package which includes a month’s supply of Gaspari Nutrition product, t-shirt and gym bag, and $500 (USD) spending money; Approximate Retail Value (ARV): $3,800, (actual ARV may vary based on winner’s point of departure and existing rates at time of travel). Winner’s guest must be 18 years of age or older. Trip must be taken on dates specified by Sponsor, or prize will be forfeited. Travel subject to availability and confirmation of reservations, certain travel restrictions may apply, the trip may not be combined with any other offer. Winner and guest must travel on the same itinerary at the same time. Winner and guest must complete a travel release prior to departure. All taxes, incidentals, meals, ground transportation and any other costs not specifically stated within these Official Rules are the sole responsibility of the winner. If winner is deemed a minor in his/her state or place of residence, he/she must be accompanied by a parent or legal guardian on the trip. Final travel arrangements including exact location in Las Vegas and choice of hotels, to be determined by Sponsor in its sole discretion. Winner and guest are responsible for obtaining travel insurance (and all other forms of insurance) where applicable, at their option, and hereby acknowledge that the Sponsors have not and will not obtain or provide travel insurance or any other form of insurance. If any part of the trip’s itinerary is unable to take place as planned, for any reason, beyond the control of the Sponsor, including but not limited to, cancellation, scheduling conflicts, political conflicts or war or an event of force majeure, the remaining components of the prize will be awarded and Sponsor’s obligation to the winner will be fulfilled, and no other additional compensation will be provided. Prize may not be transferred, substituted or redeemed for cash, except at the Sponsors’ sole discretion. Sponsor reserves the right to substitute a prize of equal or greater value if advertised prize is unavailable at the time the prize is awarded. Five (5) First Prize Winners: A month’s supply of Gaspari Nutrition products including one (1) SizeON Arctic Ice, one (1) Superpump250 Raspberry Lemonade, one (1) 5 lb chocolate Myofusion, one (1) PlasmaJet, one (1) Cytolean V2, one (1) 2 lb strawberry IntraPro, one (1) Gaspari Nutrition gym bag and one (1) Shaker Cup; ARV: $418.35/each. Ten (10) Second Prize Winners: One (1) Gaspari Nutrition gym bag, one (1) Shaker Cup and one (1) SuperPump250 Raspberry Lemonade; ARV: $92.89/each. Monthly prizes: Ten (10) prizes per month will be awarded (for a total of 120 prizes over a 12-month period): One (1) 2 lb Myofusion, one (1) Shaker Cup, one (1) T-shirt (size XL); ARV: $47.93/ea. The total ARV of all prizes is: $12,572.25. All taxes and any other costs not specifically stated within these Official Rules are the sole responsibility of the winner. 7. CONDITIONS OF PARTICIPATION:By entering, entrants agree to be bound by these Official Rules including all eligibility requirements. By accepting a prize, winner consents to the use of his/her name, image, likeness, photograph, voice, and biographical material for advertising, publicity and promotional purposes by Sponsor, or a party designated by the Sponsor, including, but not limited to, any online announcements, without additional compensation, except where prohibited by law. All entrants release and hold harmless Sponsor and their respective parent companies, subsidiaries, affiliated and related entities and Strobe Promotions, Inc., and each of their respective officers, directors, employees, contractors, agents, successors and assigns ("Releasees"), from any claims, actions, injury, loss or damage of any kind, including but not limited to, personal injury or death, resulting from participating in this Sweepstakes or from the acceptance, possession, or use or misuse of any prize awarded or participation in any prize-related activity.
8. GENERAL:Sponsor will collect information from entrants for the purpose of the prize drawing and to notify winners. Sponsor will not share this information with any third parties, except as necessary for the administration of the Sweepstakes. Sponsor and the operator of the promotion are not responsible for lost, late, illegible, misdirected, or stolen entries or transmissions, or problems of any kind, including but not limited to printing errors, whether mechanical, human or electronic. Releasees are not responsible for technical, hardware or software malfunctions, telephone failures of any kind, lost or unavailable network connections, inability to access a website or submit an online entry form, fraud, incomplete, garbled, or delayed computer transmissions or inaccurate transcription of entry information, whether caused by the Sponsor, users or by any of the equipment or programming associated with or utilized in this promotion or by any technical or human error which may occur in the processing of submissions which may damage a user's system or limit a participant's ability to participate in the promotion. Sponsor reserve the right, in their sole discretion, to cancel or suspend part or all of this Sweepstakes at any time without notice if in the opinion of administrator or Sponsor there is any suspected or actual evidence of electronic or non-electronic tampering with any portion of the Sweepstakes, or if virus, bugs, non-authorized human intervention or other causes corrupt or impair the administration, security, fairness or integrity and proper play of the Sweepstakes. In such event, Sponsor may void any entries they suspect are at issue and award prizes in a random drawing from among all eligible entries received up to the date of cancellation. Caution: Any attempt by an entrant or any other individual to deliberately damage the website or any online service related to this promotion or undermine the legitimate operation of the Sweepstakes may be a violation of criminal and civil laws and should such an attempt be made, Sponsor reserve the right to seek damages (including attorney's fees) from any such person to the fullest extent permitted by law, including criminal prosecution. Sponsor's failure to enforce any term of these Official Rules shall not constitute a waiver of that or any other provision. Sponsor reserves the right to disqualify entrants who violate the rules or interfere with this Sweepstakes in any manner. If an entrant is disqualified, Sponsor reserves the right to terminate that entrant's eligibility to participate in the Sweepstakes.
9. DISPUTES:Except where prohibited, all issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the participant and Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of the State of New Jersey, without giving effect to any choice of law or conflict of law rules (whether of the State of New Jersey, or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of New Jersey.
